Terms of service

Clear terms for the free CHCA consumer website.

These Consumer Terms of Service govern your use of the consumer-facing Certified Health Care Advisor™ website and consumer services provided by Certified Healthcare Advisors, LLC. They do not govern advisor certification, advisor enrollment, advisor accounts, or the advisor platform. By using the consumer website, submitting a form, requesting a match, or registering for a consumer event, you agree to these Terms.

Consumer services

CHCA provides general educational information, a free service that introduces consumers to eligible independent advisors, consumer contact support, and free educational or promotional events. CHCA does not charge consumers to request or receive an advisor match.

A match request is an introduction, not a contract for professional services. It does not require you to hire an advisor, buy an insurance product, enroll in a plan, or pay a planning fee.

Eligibility and authority

The consumer services are intended for adults age 18 or older. If you request help for another adult, you confirm that you have that person's permission to share the limited information submitted and to request the introduction.

You agree to provide accurate, current information and not to impersonate another person, submit fraudulent requests, interfere with the website, attempt unauthorized access, or use information obtained through CHCA for unlawful purposes.

Advisor eligibility and matching standards

For every consumer match, CHCA requires the selected advisor to have:

  • Active Certified Health Care Advisor™ certification and good standing with CHCA; and
  • An active insurance license for the consumer's state.

CHCA uses the consumer's state, requested type of help, preferred meeting format, advisor eligibility, and availability to make a match. CHCA may rely on advisor attestations, licensing records, and other information available to CHCA. Eligibility screening reduces risk but does not guarantee an advisor's performance, advice, availability, or continued licensing after the match.

CHCA generally shares match information with one selected advisor at a time. Before the advisor accepts the assignment, the advisor receives only limited routing information and not the consumer's full personally identifying information. After acceptance, the advisor may receive the information needed to respond.

The advisor has 48 hours to accept the assignment. After acceptance, the advisor is required to record a first contact attempt within 48 hours. If an advisor does not accept, declines, becomes ineligible, or does not meet required steps, CHCA may flag or reassign the request to another eligible advisor. If no eligible advisor is available in the consumer's state, CHCA may place the request in administrator review and notify the consumer. These timing standards are operational requirements, not a guarantee that contact or a successful match will occur within a particular time.

Independent advisors

Matched advisors are independent professionals. They are not CHCA employees, partners, agents, fiduciaries, or representatives and cannot bind CHCA.

The advisor—not CHCA—is responsible for the advisor's services, recommendations, communications, professional judgment, licensing, regulatory compliance, fees, and agreements with consumers. CHCA does not direct an advisor's recommendations and does not guarantee that a particular plan, product, service, or outcome is suitable for you.

You decide whether to communicate with, engage, pay, or follow the recommendations of an advisor. You may ask questions, request written scope and fee information, decline services, or request another match, subject to availability.

Planning fees and insurance enrollment

The match itself is free. An independent advisor may offer optional fee-based planning services. Planning fees vary by the services and advisor and must be disclosed in writing before you agree to work together or make payment.

A planning fee pays for professional time, analysis, planning, and recommendations. It is not a fee for insurance enrollment. If an advisor charges a planning fee for a covered individual, that advisor forfeits the ability to enroll that individual under the advisor's license. Planning and enrollment must remain separate. Any enrollment for a fee-paying client must be referred to or completed through the insurance carrier, the Centers for Medicare & Medicaid Services (CMS), or another properly licensed agent or professional.

Insurance enrollment remains available without paying a consulting fee through a licensed agent, an insurance carrier, Medicare.gov, 1-800-MEDICARE, or a State Health Insurance Assistance Program (SHIP).

Before any planning payment, you must receive and electronically sign the current Client Disclosure & Fee Agreement showing the covered individual or individuals, client state, advisor and license information, scope, fee, separation rule, refund terms, and rolling 12-month planning limitation.

Healthcare and emergency disclaimer

Consumer website content and a match request are general information and referral services. They are not medical care, medical diagnosis, treatment, legal advice, tax advice, financial advice, insurance advice, or an emergency service.

Emergency notice

Do not use this website for a medical or safety emergency. Call 911 or the appropriate emergency service. For Medicare information, you may also contact Medicare through official government channels.

Do not submit medical records, detailed diagnoses, Social Security numbers, Medicare identification numbers, payment-card information, passwords, or other highly sensitive information through a matching or general contact form.

Consumer communications and consent

Submitting a match or contact request authorizes CHCA to send transactional communications needed to process and respond to the request. A matched advisor may contact you by telephone or email regarding the requested help.

Text messages require separate, optional SMS consent and are not a condition of receiving a match or purchasing anything. Promotional marketing requires separate optional consent. You may withdraw marketing consent through the communication instructions or by contacting CHCA.

Free events

CHCA consumer events are free unless a specific event page expressly states otherwise. Attendance does not require a purchase. You may cancel a free RSVP at any time so the space can be released.

If CHCA photographs or records an event, the registration page or venue will provide notice. CHCA will seek separate permission before using an identifiable close-up image, name, or testimonial as described in the Consumer Privacy Policy.

Privacy

CHCA handles personal information under the Consumer Privacy Policy. By submitting information, you acknowledge those practices. CHCA does not sell personal information and uses consumer match information only for permitted matching, administration, compliance, support, security, and separately consented communications.

Independent advisors may have their own privacy notices and legal obligations. Once you choose to engage an advisor outside the CHCA matching workflow, the advisor is responsible for explaining the advisor's independent privacy practices.

Intellectual property

The consumer website, CHCA name and marks, certification marks, text, graphics, designs, downloads, and other content are owned by or licensed to CHCA and are protected by applicable law.

CHCA grants you a limited, personal, nonexclusive, nontransferable, revocable right to use the consumer website for lawful, noncommercial purposes. You may not copy, reproduce, scrape, modify, sell, republish, frame, reverse engineer, or exploit CHCA content or systems without written permission, except for rights that cannot lawfully be restricted.

Third-party services and links

The website may link to independent advisors, insurers, government resources, event platforms, maps, email providers, analytics tools, or other third parties. Their services and privacy practices are governed by their own terms. CHCA does not control and is not responsible for third-party content, availability, security, products, or services.

A link or introduction does not constitute CHCA endorsement of every statement, recommendation, product, or service offered by the third party.

Availability and changes

CHCA may update, suspend, restrict, or discontinue consumer website features; correct errors; refuse fraudulent or abusive requests; and change these Terms prospectively.

Material changes will be posted with an updated version and effective date and, when appropriate, communicated to affected users. Continued use after the applicable effective date means you accept the revised Terms. Changes do not retroactively alter a completed paid engagement between you and an independent advisor.

Disclaimers

To the fullest extent permitted by law, the consumer website and matching service are provided "as is" and "as available." CHCA does not warrant uninterrupted access, error-free operation, a match in every state, advisor availability, contact within a guaranteed time, or a specific healthcare, insurance, financial, or personal result.

Nothing in these Terms limits a warranty, remedy, or consumer right that cannot lawfully be waived.

Limitation of liability

To the fullest extent permitted by law, CHCA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost opportunities; or losses caused by an independent advisor, insurer, government program, carrier, website, or other third party.

For claims arising solely from the free consumer website or free matching service, CHCA's aggregate liability will not exceed one hundred dollars ($100), except where a different limitation is required by law. This limitation does not apply to liability that cannot lawfully be limited.

Withdrawal, suspension, and termination

You may withdraw a match request at any time without charge by using an available cancellation method or contacting support@certifiedhealthcareadvisor.com.

CHCA may suspend or end access to consumer services for fraud, abuse, security risk, unlawful conduct, interference with the website, or violation of these Terms. Provisions that by their nature should survive—including intellectual property, disclaimers, liability limits, governing law, and record-retention obligations—survive termination.

Governing law and venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Before filing a legal action, the parties will provide written notice of the dispute and attempt a good-faith informal resolution. Any unresolved action must be brought in the state courts located in Fulton County, Georgia, or the federal courts with jurisdiction over Fulton County, Georgia. These Terms do not require mandatory arbitration and do not include a class-action waiver.

Miscellaneous

These Terms, together with the Consumer Privacy Policy and Consumer Cancellation Policy, are the entire agreement between you and CHCA concerning the consumer website and free consumer services.

If a provision is held unenforceable, the remaining provisions remain effective. CHCA's failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without CHCA's written consent. CHCA may assign these Terms in connection with a merger, reorganization, financing, or sale of relevant assets.
